On April 1, the California Department of Financial Protection and Innovation issued a notice extending the deadline for submitting the 2021 California residential mortgage loan report, also known as the California Holden Act report, to June 13, 2022. (The report is typically due by March 31 each year.)
Notably, only companies engaged in residential mortgage lending, specifically, are required to complete the report. (This includes, but is not limited to, certain California Financing Law licensees and California Residential Mortgage Lending Act licensees.) Further, certain residential mortgage lenders are exempt from completing the entire report; however, they must still respond with a single page of the report identifying the basis upon which they are so exempt.
The DFPI was significantly delayed this year in providing the report form (which is the reason for the extension), and had been providing the following canned response to those who reached out about it:
The “new & revised” form is not available at this time. Please do not use last year’s form. Once the Residential Mortgage Loan Report form is uploaded on the website, you will be notified via your designated email address. We are sorry for this inconvenience.
The completed report or exemption page, as applicable, must be scanned and emailed to [email protected] by the new June 13 deadline.
